Work out the days late from datesOptional. The days penalised run from the date the work was due, extensions included, to the provisional acceptance date, and public holidays count (General Specification art. 29/1). Once both dates are in, the days are filled in; you can still change them by hand.

The day the work was completed fit for provisional acceptance; the acceptance committee records it in the minutes (General Specification art. 41/8).

Tenders announced before that date have no 15% penalty cap; the tool then leaves the cap out and does not ask for earlier penalties. For these tenders art. 25.2 says only "contract price"; the word "first" came in with the amendment in force from 18.08.2019 (Official Gazette 8.8.2019/30856). The tool still uses the first contract price; the two differ only where the work was increased.

Method

How the delay penalty is calculated

If the contractor does not finish on time, each day late costs the rate written in the contract, applied to the first contract price.

Formula

Daily penalty = first contract price × daily rate

Delay penalty = daily penalty × days late

The total is rounded to the kuruş once; the daily figure is rounded for display only. All penalties together, delay included, cannot pass 15% of the first contract price.

Rules applied

A rate of 3 to 6 per 10,000
The administration writes into the contract a daily rate of no less than 0.03% and no more than 0.06% of the first contract price (Standard Contract art. 25.2, fn. 22).
The first contract price
The daily penalty is worked out on the first contract price; a price grown by work increases does not grow the penalty (art. 25.2).
Ten days' notice
The penalty applies after written notice of at least ten days. Days covered by a time extension do not count as late (art. 25.1).
Deducted from payments
The delay penalty comes off progress payments without further protest; what they cannot cover is collected from the contractor separately (art. 25.4).
15% penalty cap
All penalties together, delay included, cannot pass 15% of the first contract price; if they would, the performance bond is forfeited and the contract terminated (art. 25.7, Law No. 4735 art. 20/b).
Partial acceptance
Where partial delay penalties are provided for, the penalty applies only to the parts not finished, not to the whole contract price (art. 25.6).

What this tool does not calculate

It does not work out the completion date: you enter it with extensions included, or find it with the work duration tool. It does not handle part-by-part penalties under partial acceptance. It does not calculate other penalties, such as for technical staff; enter the total already deducted and it counts that against the 15% cap only.

About the delay penalty

The administration sets it in the contract. Under the Works Standard Contract the daily rate cannot be under 3 per 10,000 (0.03%) or over 6 per 10,000 (0.06%) of the contract price (art. 25.2, fn. 22). For tenders announced on or after 18.08.2019 it applies to the first contract price.

The first contract price (art. 25.2). A price grown by work increases does not grow the daily penalty. Where partial delay penalties are provided for, the penalty applies only to the parts not finished (art. 25.6).

As the calendar days after the date the contract says the work should be finished. Days covered by a time extension do not count as late (art. 25.1).

Yes. When the contractor does not finish on time, the penalty applies after written notice of at least ten days (art. 25.1). If the delay continues after the notice period, the performance bond is forfeited and the contract terminated (art. 25.3).

Yes. All penalties deducted under the contract, delay included, cannot pass 15% of the first contract price. If they would, penalties are deducted up to 15%, the performance bond is forfeited and the contract terminated (art. 25.7, Law No. 4735 art. 20/b). The cap applies to tenders announced on or after 18.08.2019.

It comes off progress payments without further protest; what they cannot cover is collected from the contractor separately (art. 25.4). On the payment cover it appears among the deductions as "f) Gecikme Cezası".

Provisional article 7 of Law No. 4735 allowed, for works tendered under Law No. 4734 before 1.3.2023, contracted in Turkish lira and whose provisional acceptance had not been approved as of 28.12.2023, an additional price adjustment for the parts of the work carried out in 2024 and a time extension of up to six months granted by the administration. An extension granted comes off the days late. The article is specific to 2024; its paragraphs 3 and 4 were annulled by the Constitutional Court's decision of 22.7.2025, E.2024/54, K.2025/163 (the annulment took effect on 9.9.2026).
