How the dates are worked out
The completion date follows settled administrative practice; the other periods follow the general rule of the Code of Obligations. The calculator keeps the two rules apart.
End = site handover + duration − 1 + approved extensions
The handover day is the first day of the duration. A 600-day work handed over on 15.04.2011 ends on 04.12.2012, for example, and on 10.12.2012 with a 6-day extension (a Public Works Board decision).
Periods
- The handover day counts
- The duration runs from the site handover date, and that day counts too (Model Contract 9.2). The legislation does not spell out the counting; this is the settled practice of administrations and the Public Works Board.
- Extensions
- Approved extension days are added to the completion date as calendar days.
- Work programme in 15 days
- The contractor hands in the work programme for approval within 15 days of the site handover (Model Contract 12.1).
- Payment 30 + 30 + 15 days
- A payment report is approved within 30 days of being handed in, accrued within the next 30 days and paid within 15. The contract may write another payment period instead of 15 days (Model Contract 11.2).
- Final acceptance
- The time between provisional and final acceptance is the guarantee period; unless the contract says otherwise it cannot be under 12 months. It runs from the date the provisional acceptance counts from (General Specification art. 42).
- Counting the other periods
- For the other periods set in days, the first day does not count (Turkish Code of Obligations art. 92; Law No. 4734 art. 64). When months are added and the target month has no such day, its last day is taken. Public holidays are not taken into account.
What this tool does not cover
It does not take public holidays, non-working seasons or interim deadlines in the work programme into account. Partial acceptance, the time owed for a work increase and the delay penalty amount are outside its scope; use the delay penalty tool for the penalty.
